Terms of Service

These Terms govern your use of Canner (“the Service”), a deployment platform operated from Montreal, Quebec. By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. The Service

Canner builds and hosts your applications on infrastructure located in Quebec, Canada. We provide compute, an HTTPS endpoint, a Postgres database per project, log streaming, and integration with GitHub for git-push deploys.

2. Plans and billing

  • Starter: permanent free plan. Includes 1 project, up to 256 MB pooled application memory, up to 2 GB build memory, and a 5 GB database. Application memory and build resources on Starter are pooled across free accounts and deprioritized: when Basic or Pro builds are in the queue, Starter builds wait, and during host memory pressure paid tenants are served first. Apps idle longer than 24 hours are stopped and resume on the next request (cold-start). No credit card required to create or keep a Starter account.
  • Basic: CA$9 per month (or CA$90 per year, save 2 months). Includes up to 5 projects, 512 MB application memory, up to 2 GB build memory, a 5 GB database per project, custom domains with auto-TLS, and a free .com or .ca domain registration through Canner’s registrar partner. Annual billing extends the free-domain offer to .quebec as well. Billing starts immediately at the chosen interval; no trial period.
  • Pro: CA$19 per month (or CA$190 per year, save 2 months). Includes up to 25 projects, 1 GB dedicated application memory, up to 4 GB build memory, a 25 GB database per project, custom domains with auto-TLS, and a free .com, .ca, or .quebec domain registration (either billing interval). Always-warm runtime is available as an opt-in toggle. Pro tenant runtimes are prioritized over pooled tiers for memory under host pressure, but remain secondary to host services and in-progress builds. Billing starts immediately; no trial period.

Plans renew at the chosen interval until you cancel. We bill in Canadian dollars and remit applicable Quebec sales taxes (GST/QST). Cancelling stops future charges and returns your account to Starter at the end of the current period; we don’t pro-rate partial months. Free domain registrations are held with Canner’s registrar partner for the duration of your paid plan; on cancellation you may transfer the domain out using the standard registrar handoff procedure.

3. Your account

You are responsible for safeguarding your password and any actions taken under your account. Notify us immediately at security@canner.ca if you suspect unauthorized access. You must be at least 18 years old to create an account.

4. Acceptable use

You may not use the Service to:

  • Host malware, phishing pages, or content that violates Canadian law.
  • Send unsolicited commercial email (spam) from your application.
  • Mine cryptocurrency or run other workloads that disproportionately consume CPU, memory, or network resources beyond reasonable application use.
  • Interfere with or attempt to access other tenants’ data or processes.
  • Reverse-engineer, scrape, or systematically copy the Service except as expressly permitted.

We may suspend or terminate accounts that violate these rules, with notice where possible and immediately where necessary to protect the platform or other users.

5. Your content

You retain all rights to your source code, environment variables, database contents, and any other data you submit (“Your Content”). You grant Canner a limited, non-exclusive licence to host, process, and serve Your Content solely as needed to operate the Service. We don’t use Your Content to train machine-learning models.

6. Service availability

We aim for high availability but make no formal uptime guarantee on the Starter, Basic, or Pro plans. Maintenance windows are announced in advance where possible. Cold-started apps may take a few seconds to wake; if always-warm runtime is critical for your application, enable the always-warm toggle on Pro.

7. Data residency and security

Customer data is stored in Quebec. See our Privacy Policy for a full list of subprocessors and our security practices.

8. Termination

You may delete your account at any time from the dashboard. We may terminate your account for material breach of these Terms or non-payment after a 14-day grace period. On termination, we delete your data within 30 days, except where retention is legally required.

9. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by Quebec law, Canner disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Liability

Canner’s total liability arising out of or related to the Service, in any 12-month period, is limited to the amount you paid us during that period. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data, except where applicable law prohibits this limitation.

11. Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. The courts of Quebec, judicial district of Montreal, have exclusive jurisdiction over any dispute, except where prohibited by mandatory consumer-protection law.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email to active customers at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
